KL High Court Orders 74yo M’sian Man & 38yo Mistress to Pay His Wife Over RM500k for Having an Affair

The Kuala Lumpur High Court has ordered a 38-year-old woman to pay damages of up to RM200,000 to a housewife for destroying her marriage of almost 5 decades.

According to a report by Berita Harian, Judge Envrol Mariette Peters also ordered her 74-year-old husband to pay a lump sum of RM205,000 in alimony to his 72-year-old wife. On top of that, the husband and mistress duo were also made to pay RM100,000 as additional costs to the wife.

The husband and wife’s marital assets, on the other hand, were ordered to be divided equally; which includes real estate, gold savings and shareholdings in companies.

The judge considered this approach to ensure the rights of the housewife, who had sacrificed her career to ensure their family, which includes 6 children, was not neglected.

 

The man claimed he couldn’t perform in the bedroom

This comes after the judge ruled that the husband had committed adultery despite him denying having had affairs with other women, and claimed that he is impotent.

However, the court did not accept this reason after he had failed to submit medical evidence such as doctors’ reports or treatment records to support this claim.

The judge shared that there was evidence that the husband was adulterous as his mistress had spent the night at his residence in Kampar and that the duo had shared a hotel room in Singapore, despite their claims that they slept in separate beds.

The mistress also admitted that the man had stayed over at her condominium, though stating that it was only related to a meditation session.

There were also communications between the duo regarding fertility treatment (IVF), which shows that they were planning to have children together.

 

The verdict

Hence, with the evidence presented, the judge rejected the husband’s defence that he was unable to have sexual intercourse due to his alleged impotence.

“Throughout the trial, he claimed that his impotence problem caused him to no longer have sexual intercourse with his wife and that he could not possibly have been involved in an adulterous relationship with his mistress,” she said in the judgement.

The court found that the husband and his mistress were cohabiting and involved in adultery, which ultimately caused a breakdown in his marriage with his wife.

This all started in September 2022, when the husband admitted to his wife that he had met someone he wanted as his life partner and caregiver in his old age. Following this, the wife immediately filed for divorce.
