The Selangor government has confirmed that there are currently no laws stating that individuals cannot drink alcohol in public areas. State local government, public transport and new village development committee chairman Ng Sze Han said that this was mentioned in the Park Bylaws (MBPJ 2005).

According to Berita Harian, he said that although there were no exact laws stating that drinking alcohol was breaking the law, stern action will be taken against individuals who cause chaos or become a public nuisance while drinking. This is actually not something new as there is no act, by-law or enactment against drinking alcohol in public places.

“The police have the authority to take action against those who drink alcohol if any untoward incidents happened. The local authorities can also take action by conducting patrols at public locations so if there are any drunken disturbances, they can directly lodge a police report,” he added.

He answered this in response to Chua Wei Kiat, who had asked him what would the Selangor government do if they encounter any drunken disturbances in public areas. However, Ng said that they have ordered the local authorities to take the initiative to put noticeboards to warn people against drinking alcohol in public places so that it is safe for other users.

He explained, “The government has also set some guidelines against selling alcohol that can be used by the local authorities, such as putting signboards that forbid the selling of alcohol to customers under 18 years old.” The Selangor government has also said that they have set operation guidelines where premises that sell alcohol can only be opened in places that are a certain distance from houses of worship such as mosques, temples, kuils, as well as government offices, schools, hospitals and housing areas.
