57yo Spa Owner in Penang Fined RM8k After Confessing to Having HIV & Exposing Others to the Virus

A 57-year-old spa owner who was arrested during a raid at a Penang spa last weekend confessed to having the Human Immunodeficiency Virus (HIV) and exposing others to the virus.

At the Bukit Mertajam Magistrate’s Court yesterday (5 December), the man also admitted to keeping pornographic materials on his mobile phone.

Khor Yik Keian told the court that he had exposed others to the virus through his actions. He is accused of committing the offence at the premises of Unique Two Recreation Centre, Jalan Perai Jaya 4, Perai, at 7 PM on 29 November.

The offence is charged under Section 12(1) of the Prevention and Control of Infectious Diseases Act 1988 (Act 342) and is punishable under Section 24(a) of the same Act.

For the second charge, he was accused of possessing obscene material, namely photos and videos, on an Oppo Reno 11 mobile phone, under Section 292(a) of the Penal Code, which carries a prison sentence of up to three years, a fine, or both.

For both charges, Yik Keian was fined RM8,000

In separate proceedings at the same court, three men, Syed Al Aisy Syed Alfarley, 19; Teoh Wan Seong, 37; and Ahmad Safwan Razali, 33, were also charged with committing gross indecency against Mohamad Azuddin Sabran, 58, and Khor Yik Keian at the same spa and sauna centre.

All three were charged under Section 377D of the Penal Code, read together with Section 34 of the same Code, as reported by Utusan and Kosmo.

However, they pleaded not guilty and were each granted bail of RM12,000 for both charges.

Meanwhile, Syed Al Aisy, Ahmad Safwan, Teoh Wan Seong, Chinese national Luo Yun, 41; A. A Mathiyalagan, 31; and Mohd Redduwan Zairukaperi, 48, were also charged with possessing obscene material on their respective mobile phones at the same location, date, and time, under Section 292(a) of the Penal Code, which carries a prison sentence of up to three years, a fine, or both.

 

All seven individuals were among 13 suspects arrested by police in an operation at a spa in Perai on 29 November.
