“It won’t interfere with investigation” – MOE Reveals Why Melaka Gang Rape Suspects are Allowed to Sit for SPM

Education Minister Fadhlina Sidek said yesterday (12 October) that the SPM students, who are currently being investigated under Section 375B of the Penal Code for gang rape in a Melaka school classroom, are allowed to sit for their Sijil Pelajaran Malaysia (SPM) examinations.

In her statement, she also clarified that their examinations will not interfere with the ongoing investigations. The suspects will be remanded until 16 October.

The suspects have the right to sit for the SPM

In a statement by the Ministry of Education (MOE) last night, the ministry clarified that while the suspects are allowed to sit for SPM, students who are found guilty in the case will be expelled from school. 

MOE also clarified that the suspects, despite being under investigation, reserved the right to sit for their SPM.

“The Ministry made the same decision in 2019, involving 7 students in Sabah for a sexual assault case.”

The SPM is scheduled to begin on November 3; however, MOE did not clarify the location of the SPM examinations for the students involved in this case.

On 2 October, the 15-year-old victim was gang-raped by two SPM students, while their peers recorded the ordeal and guarded the place. The video circulated, and the teacher immediately alerted the police before the authorities nabbed all four suspects.

UMNO Youth Chief, Datuk Dr Akmal Saleh, responded to the shocking matter, saying that all teachers should be given absolute caning power to educate the youth.

At the time of writing (13 October), the victim is receiving treatment in the hospital and undergoing psychotherapy sessions.
