A man in Kelantan was caught sexually abusing his underage daughter, who is not even 15 years old.

The 44-year-old father pleaded NOT guilty in Kelantan court today, and he had a reason for that.

“I didn’t do it on purpose,” the defendant told the court, reported 8TV News and Harian Metro.

The accused raped his 14-year-old and 11-month-old daughter at his residence in Kampung Sungai Sam, Kuala Krai, at 5 am on July 21 (Sunday).

His actions violated the Section 376(3) of the Penal Code (incest). If found guilty, it means a maximum of 30 years of jail time for him and 10 strokes of the cane.

He was also charged with committing non-physical sexual assault on the same victim, in violation of Section 15 (C) (non-physical sexual assault on a child) of the Child Sexual Offences Act 2017 (Act 792).

If found guilty of the 2nd charge, the man will face another 10 years of imprisonment and a fine of not more than RM10,000.

The defendant also requested bail and stated in court that he needed to care for his 3 children.

The prosecutor believed that the victim was the defendant’s biological daughter, and based on the seriousness of the case, he asked the judge not to grant the defendant bail.

The judge refused to grant bail to the defendant, and the case was scheduled to be re-heard on August 28.
