Days Before Starting Work in S’pore, 24yo Johor Man Jailed 1 Day & Fined RM10k for Riding Motorbike While Drunk

The Yong Peng Magistrate Court has sentenced a 24-year-old Malaysian man to 1 day in jail and a fine of RM10,000 yesterday (24 June) after he pleaded guilty to riding a motorcycle while drunk. 

The man, Sivan Vijayan, was accused of committing the offence at kilometre 2 of Jalan Yong Peng-Labis, Yong Peng, Johor, at approximately 1.12am on 27 May.

According to Kosmo!, the charge was framed under Section 45A(1) of the Road Transport Act 1987 for driving or being in charge of a motor vehicle with an alcohol concentration above the prescribed limit.

The provision prescribes a punishment of imprisonment up to 2 years and a fine between RM10,000 and RM30,000 for a first conviction. For a second and subsequent conviction, offenders face imprisonment of up to 5 years and a fine between RM20,000 and RM50,000.

Besides that, a person convicted under this Section shall also be disqualified from holding or obtaining a driving license for at least 2 years from the date of conviction.

 

The accused is set to start a new job in Singapore at the end of June

According to the facts of the case, police personnel encountered the accused acting in a suspicious manner while conducting ‘Op Mabuk’ on the road. He was then brought to the Yong Peng police station, where the accused was found to be in an intoxicated state.

After he pleaded guilty in court, Magistrate Arun Noval Dass sentenced him to 1 day in jail and a RM10,000 fine. Furthermore, his driving license was suspended for 2 years starting 24 June.

The accused, who was not represented in court, has since paid the RM10,000 fine.

His conviction comes just a few days before the accused is set to start a new job in Singapore at the end of June.
