Employers Who Don’t Provide Proper Housing For Workers Can Be Fined RM50,000

Employers in Malaysia, take note.

You can now face a maximum fine of RM50,000 if you fail to comply with the Workers’ Minimum Standards of Housing and Amenities Act 1990 (Act 446) which will be fully enforced starting 1 September 2020.

The Department of Labour of Peninsular Malaysia (JTKSM) will enforce the act to ensure all employers comply with the provision of the laws, said Datuk Seri M.Saravanan, Malaysia’s Human Resources Minister, according to BERNAMA.

“Starting from next Tuesday, employers must comply with Act 446 by providing proper housing and accommodation as well as other facilities for the workers.”

Previously, the Act 446 jurisdiction only covered the housing and accommodation aspects of more than 20 acres plantation and mining sectors.

However, the Workers’ Minimum Standards of Housing and Amenities (Amendment) Act 2019 (Act 446), which extends to all employment sectors to provide housing and accommodation for workers, was passed in the parliament last year on 15 July 2019 and has come into force since 1 June 2020.

“We will always conduct checks on the industry players to ensure they comply with the act,” he mentioned to reporters after a working visit to Menara Top Glove on 26 August 2020.

Proper housing and accommodation is very essential and is considered basic necessities for the workers.

The Executive Chairperson of Top Glove Corporation Bhd, Tan Sri Dr Lim Wee Chai was also present at Menara Top Glove.

Top Glove Corporations is a Malaysian manufacturing company which specialises in rubber gloves, face masks and other products.
