Two brothers from Sibu, Sarawak pleaded guilty yesterday (16 December) for raping a 16-year-old girl, who became pregnant, in June this year. The 25-year-old man and his 14-year-old brother were taken to separate courts as the younger sibling was a minor.
According to Borneo Post, the man identified as Kong Ming Hua will be punished with two strokes of the cane and 12 years in jail for raping an underaged girl, who has intellectual disabilities. Judge Caroline Bee Majanil gave the order at the Sessions Court yesterday.
Meanwhile, his younger brother appeared in the Court for Children before Judge Muhammad Faizal Che Saad, who released him on bail of RM4,000 with the boy’s father as surety while waiting for a probation report from the Welfare Department.
The teenager was also ordered not to approach the victim, who is a neighbour, and to report himself to the nearest police station on the first day of every month until the disposal of the case.
The crime that the brothers committed is punishable with an imprisonment term of minimum 10 years and maximum 30 years, and whipping under Section 376(2)(k) of the Penal Code.
Prior to the charge in court, the victim from Jalan Stabau was brought to the clinic at Jalan Salim by her aunt on 5 December. After the checkup, she was found to be six months pregnant.
Police then arrested Kong at the family’s home in Jalan Stabau at about 1am on 10 December following a lodged report, and arrested his younger brother nearby Jalan Kampung Nyabor at about 1.45am.
Results of the investigation revealed that Kong had raped the girl in June at her house while his younger brother raped her near a river at the back of the girl’s house. The duo and the girl had been neighbours and it was discovered that the brothers would often visit the girl’s house.
During the court proceedings, Kong pleaded for a lenient sentence and asked to be spared from caning as he was remorseful for what he had done. However, DPP Mohamad Arif Aizuddin Masrom urged the court to pass a deterrent sentence to reflect the seriousness of the crime which was committed against a disabled minor.
“The mistake made by the accused is serious,” he said, according to Utusan Borneo.
“The accused’s actions are cursed for taking advantage of the disabled.”
