Datuk Seri Najib Tun Razak, was sentenced to 12 years of jail time and fined RM210 million during the SRC International trial yesterday that left the nation stunned. However, the former Prime Minister isn’t stripped of all his power yet and still can carry out his duties as the Pekan Member of Parliament until his appeal process has been completed, says Dewan Rakyat Speaker, Datuk Azhar Azizan Harun.
“According to the provisions of the Federal Constitution, his status as a Member of Parliament has not changed until all the appeal processes are completed,” told the Speaker to BERNAMA.
This means that Najib can still attend all Dewan Rakyat sessions until 27th August. According to the law, Article 48 (1) (e) of the Federal Constitution states that a Member of Parliament will be disqualified if he is sentenced to prison time totalling more than one year or if he is fined more than RM2,000 without receiving a pardon.
In yesterday’s trial (28th July), it was announced that Najib was found guilty of all seven charges that involved the criminal breach of trust (CBT), money laundering and abuse of power to misuse RM42 million in SRC International Sdn Bhd funds.
High Court Judge, Mohd Nazlan Mohd Ghazali made the decision after finding out that the prosecution successfully proved the case on all charges made against the Pekan MP.
For his crimes, Najib is sentenced to 10 years imprisonment for every three charges of CBT cases and every money laundering case. He is also facing a 12 years imprisonment sentence and a fine of RM210 million or a five-year prison sentence for cases in which he abused his position. However, he only needs to serve 12 years in prison after Judge Mohd Nazlan ordered the prison sentence to be carried out concurrently.
