A letter of demand (LOD) is meant to make a request of demands from a person, oftentimes for payments or to stop someone from doing something before the complainant takes legal action.
With that being said, LODs are considered rather serious as the complainant could very well be getting ready to take the recipient to court. So, what would you do if you received an LOD, but… It’s not for you?
Netizen, Faiz Azmi, took to his Twitter account to share how he received a LOD from a well-known brand, only to realise that it was meant for someone else with a very similar name!
He wrote, “A huge company, with a brand known by pretty much everyone in the world, sent me a Letter of Demand (LOD). They called me today to ask if I had received the LOD through my social media accounts, and I said no. They proceeded to send it through my WhatsApp. It turns out they addressed it to the wrong person. Apparently, we share very similar names.”
Unhappy with the way the brand’s legal team reacted when they realised they had sent the private and confidential document to the wrong person, Faiz is considering making a complaint about them to the relevant authorities.
“They apologised, but not before they put the blame on me for not speaking up when they were explaining on the phone how ‘I disparaged’ their brand. How can someone become a ‘compliance’ legal practitioner if they’re like this? Just sending a LOD also can be sent to the wrong recipient. I feel like I want to file a complaint to the Malaysian Bar or to their client,”
“They even had the gal to mention that the document is P&C (private and confidential) – yet they sent it to the wrong person,” he added.
While we understand that mistakes can happen, something this serious does require extra due diligence in ensuring it lands in the right hands.
