45yo Retiree in Perak Charged with Impregnating 12yo Daughter, Pleads for Lower Bail as He Has 6 Children to Support

A 45-year-old retiree pleaded not guilty to 3 charges of rape and sexual assault of his 12-year-old daughter, who is now 6 months pregnant, at the Ipoh Sessions Court in Perak today.

The man was accused of committing the acts in the main room of a house in Batu Gajah, Perak, on several occasions.

According to Harian Metro, the first charge was framed under Section 376(3) of the Penal Code, for raping his 12-year-and-9-month-old daughter at around 11.30pm in mid-December 2024.

Meanwhile, the second and third charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(a) of the same Act, for sexual assault committed at 2.30pm in mid-December and between 2.30pm and 8.30pm in January 2025.

When the charges were read against him in court today, the accused pleaded not guilty in front of Judge Jean Sharmila Jesudason.

The prosecution was led by Deputy Public Prosecutor Qurratu’aini Khalifah, while the accused was represented by his lawyer, Muhammad Farhan Ahmad Fadzil.

The latter requested that a lower bail be set for the accused, as he earns a pension of only RM1,800 monthly. The lawyer also argued that the accused is the sole breadwinner of the family, as his wife was not working, and that he has to support six children who are still in school.

The accused also promised to adhere to the strict bail conditions set by the court, including finding a separate place to stay from the victim, so that he can continue to support his family.

The court then set bail at RM21,000 with one local surety, with the additional conditions of not harassing or approaching the victim and witnesses, as well as reporting to the police station until the end of the case.

The court set 18 August 2025 for the re-mention of the case.
