30yo M’sian Man Secretly Records His Male Housemate Showering in The Nude as a “Joke”, Gets Fined RM3,300

A 30-year-old Malaysian man has been sentenced to a fine of RM3,300 by the Ampang Magistrate Court for recording a video of his 31-year-old male housemate showering in the nude last Friday (20 June).

The accused, Muhammad Fahmi Akmal Zakaria, who is an accountant by profession, pleaded guilty in front of Magistrate Amalina Basirah Md Top today.

According to Sinar Harian, the accused was charged with recording a video of the victim while he was showering with the intent to insult his modesty.

The charge was framed under Section 509 of the Penal Code for insulting the modesty of a person, which carries a sentence of up to 5 years in jail, a fine or both, if convicted.

Muhammad Fahmi was accused of committing the offence at 8.10pm on 20 June at an apartment in Taman Ukay Perdana, Ampang, Selangor.

According to the facts of the case, the victim noticed a blinking light from a camera device on an appliance rack when taking a shower at the rental apartment and suspected it was the action of the accused.

The victim then took the accused’s laptop and USB wire and found the camera device contained a memory card. Inside, the memory card had videos of the victim taking a shower in the nude.

During proceedings, counsel Mohd Azizi Darus from the National Legal Aid Foundation appealed for a minimum fine as he was financially responsible for his family.

Furthermore, the court was told that the accused committed the action as a joke, as the victim was his housemate.

However, Deputy Public Prosecutor Norhidayah Abdullah Sani urged the court to impose a deterrent sentence by considering the facts of the case so that it could be a lesson for the accused and society.

Magistrate Amalina Basirah Md Top then sentenced the accused to a fine of RM3,300.
