Dad & Daughter Charged with Khalwat & Preparing to Commit Unlawful Sexual Acts with Their Partners

On December 9, a father and daughter along with their respective partners, were charged with khalwat (close proximity) and preparing to commit unlawful sexual acts.

The accused father, Mat Husin Sulaiman, 53, a masseur, and his partner, Aslina Razali, 37, a cook, were each fined RM4,500 after being caught in a compromising situation at a house on May 19. Both also face a one-year prison sentence if they fail to pay the fine.

Sinar Harian reported that the verdict was delivered by Syariah Judge Mohd Nazri Yusof after both accused pleaded guilty to the charges read out to them.

The prosecution pushed for a harsher punishment

According to the charges, they were detained in a house at Kampung Surau Haji Daud here at around 5:20 PM on May 19.

Both were charged under Section 29 of the Syariah Criminal Offenses (Takzir) (Terengganu) Enactment, amended in 2022, for preparing to engage in unlawful sexual intercourse.

If Mat Husin and his partner are found guilty, they could be fined up to RM5,000, jailed for up to 3 years, caned up to 6 times, or any combination of these penalties.

During the appeal, both had asked for a lighter sentence because they were struggling financially and had dependents to take care of. But the prosecution pushed for a harsher punishment to set an example.

The daughter & her partner avoided caning by getting married

Meanwhile, in another court, Mat Husin’s daughter, Nurul Hadhari Mat Husin, 20, and her partner, Che Mohammad Aidil Hakim Rozali, 20, were charged with being in close proximity (khalwat).

The couple, who are private college students and got married in July, managed to avoid caning for repeated khalwat offences.

They were charged under Section 31(a)(b) of the Syariah Criminal Offenses (Takzir) (Terengganu) Enactment, which was updated in 2022.

As per the charges, they were caught for khalwat at an apartment in the district around 4:15 AM on March 18.

Judge Hamidi Syafie fined Nurul Hadhari RM3,000, or 4 months in jail if she doesn’t pay, while her partner was fined RM4,000, or 6 months in jail if he doesn’t settle the fine.
