A security guard has been sentenced to 1 month in jail by the Seremban Magistrate’s Court today (Thursday, June 26), on the charge of riding a bicycle recklessly, which led to a fatal accident in March of last year.

The accused, who was not represented by a lawyer, requested a prison sentence as he could not afford to pay a fine due to his low income as a security guard.

What happened on the day of the incident

The offence was committed at approximately 2:55pm on March 27, 2024, in front of a supermarket in Taman Desa Anggerik, Nilai, Negeri Sembilan.

According to the facts of the case, initial investigations at the scene found that the accident occurred when the security guard was riding his bicycle from Ampangan to Senawang. Upon arriving at the scene, the cyclist turned into the right intersection and suddenly, a Yamaha 135LC motorcyclist came from the opposite direction and hit him in the middle of the road.

As a result of the accident, the 28-year-old motorcyclist suffered serious head injuries and was confirmed dead at the scene.

Due to this, the accused committed an offence under Section 43(1) of the Road Transport Act 1987, read together with Section 54(1) of the Road Transport Act 1987 and is punishable under Section 54(2) of the same act.

Upon conviction, he could have been fined not less than RM1,000 and not more than RM5,000, and could have also been imprisoned for up to 12 months.
